Did you receive permission to copy some of these descriptions word-for-word from the directories stated above? I may be interested but its really concerning that there's identical descriptions to that of hotscripts and resoureceindex. I know that in the past the resourceindex has shut down sites for this, so I think this is fairly important issue to address to potential buyers.

We discussed this many times before. One of my friend talked to his lawyer also and there was no problem.
The indexed content can be found from many other resources over internet. So it can not be redirected to only one site such as HotScripts . I also showed my link to the owners of HotScripts and other sites however haven't faced any problems.

When you say that you are selling the "whole database" does that mean that the owner will receive a "copy" of the database or you will be turning over the database and the exclusive rights to it?

Was the database of this site one of the databases you've sold previously?

Please permit me to respectfully clarify some issues. The content of your site (www.phplistings.com) appears to match/duplicate the content of HotScripts.com I did not check all the listings but the first 5 were perfect matches. HotScripts has been around for years and years so it's reasonable and prudent to assume they they hold the "Copyright 1999-2003 HotScripts.com. All rights reserved. A Division of iNET Interactive." which appears at the bottom of their page. For example:

Search in Google for or any text phrase in your listing like:

GAL (Global Address List) grew out of a need for an online address book

Your page:

http://www.phplistings.com/PHP/cat.php?id=48

HotScripts.com page:

http://www.hotscripts.com/Detailed/27474.html

Although I am not an attorney and a potential buyer should consult with an attorney this appears to be a violation of the DMCA.

The Digital Millennium Copyright Act of 1998:

None of the following reasons makes this action legal and or defensable:

I sold the DB dump to..........
It's on the Web so I can use it
Everyone else is doing it
I'm not taking responsability
I'm only selling the DB dump

You and every site you listed who has purchased the data is in violation of the DMCA.

They sue you. See the RIAA cases as an example
They contact all your advertisers and file complaints since this action violates their TOS
THey contact your hosts and ask that your site be taken off line
They contact your CC gateway like PayPal and ask for chargebacks and account suspension


Given the serious risks involved in your actions, buyers are advised to consult with an experienced IP attorney prior to the purchase.

My own advice is to immediately remove all the listings/content and refund the money to all the buyers.
