Unhappy Who owns a mailing list?

Here's the situation:

A popular discussion list went down because the list owner lost his internet connection.

He has decided to keep the list down until he can get another high-speed internet connection for free, rather than accepting one of several offers other people have made to host the list, since he has a personal issue of authority.

Now, we respect him as an admin, but if he's going to keep the list down for months because of his personal issue, that's going too far.

Now, here's what I wanted to ask you guys: If someone were to take the list of e-mail addresses from the old mailing list (it's publicly viewable) and start a new mailing list, can they get in trouble somehow? Does the owner of the list have a legal right to that list of e-mail addresses?

In a nutshell, the owner owns the list. If you start using it without his/her permission then you could end up on the RBL (realtime blackhole list) - these guys do not play games - once you are on their list of bad sites, it's tough to get off. You could also have your own internet access terminated plus you could be libel for violating any privacy policies associated with the mailing list.

The best thing is start your own - don't take someone else's because you feel they are not administering it the way you think they should. It is their mailing list, not yours.
