"In March of this year, Utah became the first state to enact new legislation addressing certain types of "spyware" -- with its Spyware Control Act. (Spyware is software that tracks a consumer's online activities, and uses the data it collects to choose targeted pop-up advertisements and other promotional messages, which are then displayed to the user.)"

Law suit number 1 by Overstock:

Law suit number 2 by "Two Utah companies, Overstock.com and 1-800 Contacts, contend that WhenU ads inundate their Web sites with competitors' ads, costing them millions.

It looks like it's 10K per violation and natch, we have the lawyers involved to protect the respective interests of all parties.

What I find very surprising is that Utah would inact such a great law. Rather than NY and or CA which are normally the hot beds of leading edge state legislation. Spence?
